Acceptance of Terms
By downloading, installing, accessing, or using the InfoWine® application (hereinafter, "the App"), you agree to be bound by these Terms and Conditions (hereinafter, "the Terms"). If you do not agree with any provision herein, please do not use the App.
These Terms constitute a legally binding agreement between you (hereinafter, "the User") and InfoWine (hereinafter, "we," "us," or "the Company").
Your continued use of the App after any modification to these Terms constitutes acceptance of those changes.
Section 02
Service Description
InfoWine® is a mobile application that provides:
- Wine Repository: Access to a curated database of wines, including detailed information on varietals, appellations, and regions.
- Food & Cheese Pairing: Pairing suggestions based on enological criteria.
- Single Varietal Wines: Exploration by grape variety and appellation.
- Wine Scanner: Wine identification via UPC barcode scanning.
- Offline Database: Full database download for instant searches without internet connectivity.
- Monthly Updates: Periodic cloud-based content updates.
InfoWine® provides informational and educational suggestions only. The information does not substitute the advice of a professional sommelier or wine specialist.
Section 03
Eligibility & Account Registration
To access the App's functionalities, the User must create an account using Google Sign-In authentication. By registering, you:
- Represent that you are of legal age in your country of residence (at least 18 years of age, or the legal drinking age in your jurisdiction, whichever is higher).
- Warrant that the information provided through your Google account is truthful and up to date.
- Agree not to share your login credentials with third parties.
- Accept responsibility for all activity that occurs under your account.
- Acknowledge that only one account per individual is permitted.
We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice or obligation to refund.
Children's Privacy (COPPA Compliance — U.S.)
The App is not intended for use by persons under the age of 13 (or under 16 in the European Union). We do not knowingly collect personal information from children. If we learn that we have collected data from a child below the applicable age, we will delete it promptly. If you believe a child has provided us personal data, please contact us at info@infowine.info.
Section 04
Subscription Model
InfoWine® operates under a paid subscription model. The App offers multiple subscription tiers with varying durations. Specific pricing, plan details, and promotional offers are displayed within the App at the time of purchase and may vary by region, platform, and applicable taxes.
What all subscriptions include
- Full access to the complete wine repository.
- Full food & cheese pairing and advanced search functionality.
- UPC barcode wine scanner.
- Offline database download.
- Monthly content updates.
- Single varietal wine exploration.
The Company reserves the right to modify subscription plans, pricing, and features at any time. Active subscribers will be notified of material changes before they take effect.
Section 05
Free Trial Period
New users may be eligible for a limited free trial period starting from the date of account registration. During this period:
- The User will have full access to all App functionalities at no cost.
- No payment information is required to activate the trial.
- Upon expiration of the trial, a subscription screen (paywall) will be presented and access will be restricted until the User purchases a paid plan.
- The trial period will not automatically convert into a paid subscription.
The free trial is one-time only and non-renewable. Only one trial period is allowed per Google account. The Company reserves the right to modify the duration or conditions of the free trial at any time.
Section 06
Billing & Auto-Renewal
Payment Processing
All payments are processed through the respective app store (Apple App Store or Google Play Store). The Company does not directly store credit card numbers, banking information, or other financial data of Users.
Auto-Renewal
- Subscriptions automatically renew at the end of each subscription period unless the User cancels renewal at least 24 hours before the expiration date.
- The renewal charge will be applied to the User's app store account within 24 hours before the end of the current period.
- The renewal price will be the price then in effect on the app store at the time of renewal.
Managing Your Subscription
You can manage and cancel your subscription at any time through:
- iOS: Settings → [Your Name] → Subscriptions → InfoWine.
- Android: Google Play Store → Menu → Subscriptions → InfoWine.
Section 07
Cancellation & Refunds
Cancellation
- The User may cancel their subscription at any time. Cancellation will take effect at the end of the current paid period.
- After cancellation, the User retains access to premium features until the already-paid period expires.
- Cancellation does not generate a prorated refund for the unused portion of the current period.
Refunds
- Refund requests must be directed to the respective app store (Apple App Store or Google Play Store), in accordance with their refund policies.
- The Company does not process refunds directly, as payments are administered by the distribution platforms.
- EU Users: Under EU consumer protection law, you may have a right to a 14-day "cooling-off" period for digital purchases. This right may be waived if you expressly consent to begin using the service and acknowledge that you lose your right of withdrawal.
Deleting the App from your device does NOT automatically cancel an active subscription. You must cancel your subscription from your app store account settings.

Privacy & Data Protection
Legal Basis for Data Processing (GDPR — EU)
We process your personal data on the following legal bases under Article 6 of the General Data Protection Regulation (GDPR):
- Contractual necessity: Processing necessary to provide the App's services (authentication, subscription management).
- Legitimate interest: Improving the user experience and maintaining security.
- Consent: Where you have given explicit consent (e.g., accepting these Terms during onboarding).
Data We Collect
InfoWine® collects and stores the following personal data through Google Firebase services:
- Authentication data: Name, email address, and profile photo provided by Google Sign-In.
- Account data: Unique User Identifier (UID), trial start date, and account creation date.
- Local preferences: Visual theme (light, dark, or system) and onboarding status, stored locally on the User's device only.
Data We Do NOT Collect
- Financial or payment information (managed exclusively by app stores).
- Geolocation data.
- Contacts, messages, or data from other applications.
- Biometric data.
- Browsing or search history outside of the App.
Purpose of Data Processing
Collected data is used exclusively to:
- Authenticate and manage the User's account.
- Administer the trial period and subscription status.
- Improve the user experience within the App.
Data Storage & Security
Data is stored on Google Firebase (Cloud Firestore) servers and is protected by Google Cloud's industry-standard security practices, including encryption in transit (TLS) and at rest. Local preferences are stored on the User's device via SharedPreferences and are not transmitted to external servers.
Data Retention
We retain your personal data for as long as your account is active or as needed to provide you services. Upon account deletion request, your data will be permanently erased within 30 days, except where retention is required by law.
Section 09
International Data Transfers
Your data may be transferred to and processed in countries outside your country of residence, including the United States, where Google's Firebase servers are located. By using the App, you consent to such transfers.
For EU Users (GDPR)
Where your data is transferred outside the European Economic Area (EEA), we ensure adequate safeguards are in place, such as:
- Standard Contractual Clauses (SCCs) approved by the European Commission.
- Reliance on Google's compliance frameworks for Firebase services.
For Mexican Users (LFPDPPP)
In compliance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP), we inform you that your personal data may be transferred internationally. By accepting these Terms, you consent to such transfers, which are carried out under the protections described herein.

User Rights
Rights Under GDPR (European Union)
If you are located in the EU/EEA, you have the following rights under the GDPR:
- Right of Access (Art. 15): Request a copy of your personal data.
- Right to Rectification (Art. 16): Request correction of inaccurate data.
- Right to Erasure (Art. 17): Request deletion of your personal data ("right to be forgotten").
- Right to Restriction (Art. 18): Request limited processing of your data.
- Right to Data Portability (Art. 20): Receive your data in a structured, machine-readable format.
- Right to Object (Art. 21): Object to processing based on legitimate interests.
- Right to Withdraw Consent (Art. 7): Withdraw consent at any time without affecting prior processing.
- Right to Lodge a Complaint: File a complaint with your local Data Protection Authority (DPA).
ARCO Rights Under LFPDPPP (Mexico)
If you reside in Mexico, you have the following ARCO rights under the LFPDPPP:
- Acceso (Access): Know what personal data we hold about you and how it is used.
- Rectificación (Rectification): Request corrections to inaccurate or incomplete data.
- Cancelación (Cancellation): Request deletion of your personal data.
- Oposición (Objection): Oppose the processing of your data for specific purposes.
To exercise your ARCO rights, send a request to info@infowine.info with the subject line "ARCO Request." We will respond within 20 business days as required by law.
Rights Under U.S. State Privacy Laws
Residents of California (CCPA/CPRA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), and other states with privacy legislation may have additional rights, including:
- Right to Know: What personal information we collect, use, and share.
- Right to Delete: Request deletion of your personal information.
- Right to Opt-Out: Opt out of the "sale" or "sharing" of personal information. Note: InfoWine® does not sell or share your personal data with third parties for advertising or marketing purposes.
- Right to Non-Discrimination: Exercise your rights without receiving discriminatory treatment.

Section 11
Intellectual Property
All content within InfoWine® is protected by applicable intellectual property laws, including but not limited to:
- Software: Source code, search algorithms, classification, and pairing logic.
- Databases: The wine database, pairing data, varietal data, and all compiled information.
- Brand: The name "InfoWine®," logo, iconography, and visual design elements.
- Content: Text, descriptions, categories, and all information presented in the App.
It is strictly prohibited to copy, reproduce, distribute, modify, reverse engineer, decompile, or extract data from the App without prior written authorization from InfoWine®.
The subscription grants the User a personal, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms. This license does not grant any ownership rights over the software or its content.
Section 12
Acceptable Use
The User agrees to use the App responsibly and lawfully. The following activities are prohibited:
- Using the App for illegal or unauthorized purposes.
- Attempting to access paid features without a valid subscription.
- Manipulating, altering, or circumventing the App's security, authentication, or access control mechanisms.
- Performing scraping, data mining, or mass data extraction from the App.
- Sharing, reselling, or sublicensing App access to third parties.
- Using the App in a manner that may damage, disable, or overburden InfoWine® servers or infrastructure.
- Creating multiple accounts to obtain additional trial periods.
Violation of these rules may result in immediate suspension or termination of the User's account, without right to refund.
Section 13
Limitation of Liability
Service Availability
InfoWine® is provided "as is" and "as available." While we make reasonable efforts to keep the App operational and up to date, we do not guarantee:
- Uninterrupted availability of the service.
- The complete absence of technical errors or defects.
- The absolute accuracy of wine information, pairings, or any other content.
Disclaimer
To the maximum extent permitted by applicable law, the Company shall not be liable for:
- Direct, indirect, incidental, special, consequential, or punitive damages arising from use or inability to use the App.
- Decisions made by the User based on information provided by the App.
- Compatibility issues with specific devices, operating systems, or network connections.
- Service interruptions caused by maintenance, updates, or force majeure.
In no event shall InfoWine®'s total liability exceed the amount paid by the User for their subscription during the preceding 12 months.
Responsible Consumption
InfoWine® promotes responsible alcohol consumption. The App is an informational and educational tool; it does not encourage or promote excessive consumption of alcoholic beverages. The User represents they are of legal drinking age in their jurisdiction.
Section 14
Governing Law & Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable to the User's jurisdiction:
- United States: Federal laws and the laws of the state where the Company maintains its principal place of business.
- European Union: The laws of the EU Member State where the User resides, including the GDPR.
- Mexico: The Federal Civil Code, the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor), and the LFPDPPP.
Dispute Resolution
In the event of a dispute arising from these Terms:
- The parties shall first attempt to resolve the dispute through good-faith negotiation.
- If negotiation is unsuccessful within 30 days, the dispute may be submitted to binding arbitration or the competent courts in the User's jurisdiction, as applicable by local law.
EU Consumer Rights
If you are a consumer in the EU, you may also have recourse to the Online Dispute Resolution (ODR) Platform of the European Commission at https://ec.europa.eu/consumers/odr.
Mexican Consumer Rights
Mexican users may file complaints through the PROFECO (Procuraduría Federal del Consumidor) at https://www.gob.mx/profeco.
Section 15
Modifications to These Terms
We reserve the right to modify these Terms at any time. Changes will take effect upon publication within the App or on the website.
- Material changes will be notified to the User through the App or by email.
- Continued use of the App after publication of changes constitutes acceptance of the updated Terms.
- If the User does not accept the modifications, they must discontinue use of the App and cancel their subscription.
